Terms of Service

MakeTheDonation tracks donation programs at the point of sale: round-up pledges and fixed-amount donations. We total what your program raises, produce a monthly statement, and give nonprofits a portal to see and reconcile it.

We are not a payment processor and we never hold or move money. Every donation travels directly from a business to its chosen nonprofit, outside our platform. Statements are records of what a program raised, not invoices from us.

Keep your sign-in credentials to yourself and your information accurate. You are responsible for activity under your account. You must be authorized to act for the business or organization you register.

Donations your program records are commitments you make to your chosen nonprofit. You agree to pay the nonprofit directly, using its payment instructions, for the amounts on your statements, and to mark statements sent when you have. If a statement looks wrong, contact us before paying and we will help you reconcile it.

On the customer-pays option, amounts your customers donate at checkout are collected by you as part of your sale, and you are responsible for delivering them to the nonprofit in full.

You must be a genuine charitable organization and keep your profile accurate, including your EIN and payment instructions. You are responsible for confirming donations you receive, and for your own receipting and donor obligations.

The service is free for nonprofits. For businesses it is free during launch; if paid plans arrive, you will hear from us before anything changes, and continuing to use the service after a price change takes effect means you accept it.

We do not give tax advice. Whether and how donations are deductible is between you, your customers, your nonprofit, and your tax advisor. Statements are operational records, not tax documents.

Do not use the service to mislead customers or donors, to raise for an organization without its consent, to misrepresent who you are, or to interfere with the service or other users. We can suspend or remove accounts that do.

The service is provided as-is. We work to keep it accurate and available, but we do not guarantee uninterrupted service or that every provider event reaches us. To the fullest extent the law allows, our liability to you for any claim related to the service is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect or consequential damages. Nothing here limits liability that cannot lawfully be limited.

You can stop using the service and close your account at any time; obligations for donations already recorded survive. We can suspend or end accounts that break these terms.

If these terms change in a way that matters, we will say so before the change takes effect. These terms are governed by the laws of the State of Louisiana. Questions belong at contact@makethedonation.com or our contact page.
